Terms of Service

Effective date: September 23, 2025

1) Agreement to terms

By accessing or using dakota.school and related apps/services (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

2) Who we are

“Dakota” (“we”, “us”) is an early‑childhood development project operated from Canada. We are currently an unincorporated project. Contact: support@dakota.school.

3) Eligibility & accounts

  • You must be an adult caregiver to create an account and use the Service with a child.
  • Keep your credentials secure and notify us of any unauthorized use.
  • We may refuse, suspend, or terminate accounts for misuse or risk.

4) Acceptable use

  • No unlawful, infringing, or harmful content or conduct.
  • No scraping, reverse engineering, or circumventing security.
  • No uploading of sensitive medical records or government IDs.
  • Respect children’s privacy: you are responsible for what you record.

5) Content & IP

  • We (and our licensors) own the Service, including text, graphics, and software. All rights reserved.
  • You retain rights to content you submit. You grant us a non‑exclusive, worldwide, royalty‑free license to use your content solely to operate, secure, and improve the Service.
  • Feedback you provide may be used to improve the Service without obligation to you.

6) Educational & safety disclaimers

  • The Service provides guidance and tools. It is not medical, clinical, or diagnostic advice.
  • You are responsible for supervision and safety of children at all times.
  • We do not guarantee specific outcomes. Development varies by child and environment.

7) Beta features & changes

We may offer previews or beta features that can change, break, or be withdrawn. We may modify or discontinue the Service or features at any time.

8) Third‑party services

We rely on service providers (e.g., hosting, authentication, analytics). Their terms and privacy practices apply to their services.

9) Fees & refunds

The Service may be free during development. If we introduce paid plans, we will present pricing, billing, and refund terms at purchase. Unless stated otherwise, fees are non‑refundable.

10) Termination

You may stop using the Service at any time and request deletion of your account and associated child data. We may suspend or terminate access if you violate these Terms or create risk to others or the Service.

11) Warranties & liability

THE SERVICE IS PROVIDED “AS IS”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE EVENT OR (B) CAD $100.

Some jurisdictions do not allow certain disclaimers or limitations; those terms apply only to the extent permitted in your jurisdiction.

12) Indemnification

You will indemnify and hold us harmless from claims, damages, and costs (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.

13) Governing law & venue

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict‑of‑laws rules. Courts in Alberta, Canada will have exclusive jurisdiction, except that consumers may have additional rights in their home jurisdictions that cannot be waived.

14) Changes to Terms

We may update these Terms. If changes are material, we will notify you (e.g., in‑app or email). Continued use after the effective date means you accept the updated Terms.
